1. Limited 90-Day Commercial Warranty
Unless otherwise stated on the product page, quotation, or invoice, products sold by Les moteurs électriques P.M.R du Québec Inc are covered by a limited commercial warranty for a period of 90 days from the documented delivery date shown by the shipping carrier.
This warranty applies only to manufacturing defects or operational failures occurring under normal and proper use.
The product must have been correctly selected, installed, wired, protected, and operated according to its specifications and the manufacturer’s instructions.
This 90-day commercial warranty is provided in addition to any mandatory legal warranties or consumer rights that may apply. Nothing in this policy limits or excludes any legal right that cannot lawfully be waived.
2. Warranty Claim Requirements
All warranty claims must be submitted in writing before the end of the 90-day warranty period.
The buyer must provide:
- The order or invoice number;
- The product model number;
- Clear photographs of the product and nameplate;
- A detailed description of the problem;
- Information about the application and equipment in which the product was installed;
- The voltage, phase, frequency, wiring, and electrical protection used;
- Any test results, photographs, videos, or other information reasonably required to evaluate the claim.
No product may be returned without prior written authorization from Les moteurs électriques P.M.R du Québec Inc.
Returning a product does not automatically mean that the warranty claim has been accepted. The product must first be received, inspected, and tested.
3. Warranty Exclusions
The 90-day commercial warranty does not cover damage, failure, or malfunction caused by:
- Incorrect installation;
- Incorrect electrical wiring;
- Incorrect voltage, phase, frequency, or power supply;
- Overloading, overheating, voltage fluctuations, or power surges;
- Inadequate electrical protection;
- Insufficient ventilation;
- Incorrect motor or product selection;
- Use in an application for which the product was not designed;
- Incorrect rotation or improper control settings;
- Water, moisture, corrosion, chemicals, dirt, or excessive dust;
- Physical impact, accident, abuse, negligence, or misuse;
- Unauthorized modification, disassembly, or repair;
- Normal wear and tear;
- Damage occurring during installation, removal, handling, or transportation arranged by the buyer;
- Use of incompatible controls, parts, accessories, or equipment;
- Failure to follow the manufacturer’s instructions or product specifications.
The warranty does not cover a product simply because it does not fit the buyer’s equipment when the product supplied matches the model and specifications ordered.
4. Warranty Inspection and Decision
All warranty decisions are subject to inspection and testing.
When a covered defect is confirmed, Les moteurs électriques P.M.R du Québec Inc, at its discretion and to the extent permitted by law, may:
- Repair the product;
- Replace the product with the same or an equivalent model;
- Issue a store credit;
- Refund the purchase price of the product.
No replacement, credit, or refund will be issued before the product has been received and inspected, unless otherwise required by applicable law.
If inspection determines that the product is operating correctly or that the failure is not covered by the warranty, the warranty claim will be denied.
5. Costs Not Covered by the Commercial Warranty
To the extent permitted by applicable law, the 90-day commercial warranty covers only the product itself.
It does not cover:
- Diagnostic charges;
- Installation or removal costs;
- Electrician or technician fees;
- Labour costs;
- Service calls or travel expenses;
- Equipment rental;
- Crane, lift, or handling costs;
- Production downtime;
- Loss of income, profits, contracts, or business;
- Damage to other equipment;
- Indirect, incidental, or consequential damages.
6. Warranty Shipping Costs
For claims made under this 90-day limited commercial warranty, and unless otherwise required by applicable law, the buyer is responsible for the actual shipping, transportation, insurance, packaging, customs, brokerage, and handling costs charged in connection with the warranty claim.
This includes:
- Shipping the product to the location designated by Les moteurs électriques P.M.R du Québec Inc;
- Properly packaging and insuring the returned product;
- Return shipping of a repaired or replacement product;
- Customs duties, brokerage fees, taxes, or carrier charges, when applicable.
The buyer is responsible for safely packaging the returned product. Damage caused by inadequate packaging may result in the warranty claim being denied.
7. Returns of Non-Defective Products
Returns of non-defective products are accepted only with prior written authorization from Les moteurs électriques P.M.R du Québec Inc.
Authorization is not guaranteed.
To qualify for an approved return, the product must be:
- Unused;
- Uninstalled;
- Never electrically connected;
- Unmodified;
- Clean and complete;
- In its original packaging or equivalent protective packaging;
- In resalable condition.
The buyer is responsible for all return shipping, insurance, customs, brokerage, and handling costs.
Original shipping charges are non-refundable.
8. Restocking Fee
Approved returns of non-defective products are subject to a 20% restocking fee, calculated on the product purchase price, unless prohibited by applicable law.
The following amounts may also be deducted from the refund:
- Original shipping charges;
- Return shipping charges;
- Carrier return-to-sender charges;
- Customs or brokerage fees;
- Storage or address-correction charges;
- Missing parts or accessories;
- Damage to the product or packaging;
- Any reduction in the product’s resale value.
9. Non-Returnable Products
Unless otherwise required by applicable law, the following products are not returnable:
- Products that have been installed;
- Products that have been electrically connected;
- Used, damaged, modified, or incomplete products;
- Special-order products;
- Custom-made or specially modified products;
- Products configured according to the buyer’s requirements;
- Clearance products or products identified as final sale;
- Products returned without prior written authorization.
A defective product may still qualify for warranty coverage even when it is not eligible for a non-defective return.
10. Incorrect Selection or Ordering Errors
The buyer is responsible for verifying all product specifications before placing an order, including:
- Model number;
- Horsepower;
- Voltage;
- Phase;
- Frequency;
- Speed;
- Frame size;
- Mounting type;
- Rotation;
- Shaft dimensions;
- Physical dimensions;
- Electrical specifications;
- Compatibility with the buyer’s equipment and application.
Recommendations or product comparisons provided by Les moteurs électriques P.M.R du Québec Inc are based on the information supplied by the buyer.
The buyer remains responsible for confirming final compatibility before ordering and before installation.
An incorrect selection or ordering error made by the buyer is not considered a product defect.
11. Refused or Undeliverable Shipments
Refusing a shipment or failing to receive or collect a shipment does not automatically cancel the order.
When a shipment is returned because the buyer:
- Was unavailable during delivery attempts;
- Failed to collect the shipment;
- Refused delivery;
- Provided an incorrect or incomplete address;
- Failed to respond to the carrier;
the buyer will be responsible, subject to applicable law, for the actual costs incurred, including:
- Original shipping charges;
- Return-to-sender charges;
- Storage charges;
- Address-correction charges;
- Customs or brokerage fees;
- Reshipping charges.
The buyer may request reshipment after paying all outstanding transportation costs.
When an approved refund is requested instead, the refund may be reduced by the transportation costs incurred and the applicable 20% restocking fee.
12. Refund Processing
No refund will be processed until the returned product has been received and inspected.
Approved refunds will be issued to the original payment method whenever possible.
Shipping charges, carrier charges, customs fees, brokerage fees, and restocking fees are non-refundable unless otherwise required by applicable law.
13. Acceptance of This Policy
By placing an order with Les moteurs électriques P.M.R du Québec Inc, the buyer acknowledges having read and accepted this Return, Refund and 90-Day Limited Warranty Policy.
If any provision of this policy conflicts with a mandatory provision of applicable law, the mandatory legal provision will prevail. The remaining provisions of this policy will continue to apply.
